Terms of Service
These Terms govern access to Kepler Genomics websites, accounts, sequencing products, reports and marketplace services.
1. Operator and acceptance
The Services are operated by Kepler Genomics Technology Limited (Kepler, we, us or our). By creating an account, placing an order or using a Service, you agree to these Terms and the policies linked from the Legal & Policies page.
If you use a Service for another person, you represent that you have lawful authority and all required consent to do so.
2. Eligibility and accounts
You must provide accurate account and order information, protect your credentials and promptly report suspected unauthorized access. Access to genetic information by a minor requires a parent or legal guardian and may be subject to additional restrictions.
3. Orders, samples and payment
Prices, currency, included services, collection requirements, shipping and estimated turnaround shown at checkout form part of the order. Payment may be processed by third-party providers. An order is accepted only when Kepler issues confirmation.
Samples that are insufficient, damaged, mislabeled, unsafe or inconsistent with collection instructions may require recollection or may not be processed.
4. Genetic information and medical limitations
Genetic science evolves. Results may be incomplete, uncertain, population-dependent or change as evidence and analysis methods improve. Educational reports are not a diagnosis and do not replace a physician, genetic counselor or confirmatory clinical testing.
You should consider the personal and family implications of learning or sharing genetic information before using a report or application.
5. Uploaded data and permissions
You may upload only data that you own or are legally authorized to use. You retain rights in your data. You grant Kepler the limited permission needed to store, process and deliver the Services you request, subject to your settings, consent and the Privacy Policy.
6. Marketplace and third parties
Marketplace products may be supplied by independent developers or laboratories. Their identity, required inputs, price and applicable terms should be shown before purchase or authorization. Third-party services are responsible for their own products and statements.
7. Acceptable use and intellectual property
You may not misuse the Services, access another person's account, upload unlawful material, interfere with security, scrape protected account data or reverse engineer software except where applicable law expressly permits it. Kepler and its licensors retain rights in the Site, software, branding and original content.
8. Availability, suspension and changes
Services may be updated, interrupted or discontinued for maintenance, security, legal or operational reasons. We may restrict access when reasonably necessary to protect users, data, the platform or comply with law.
9. Disclaimers and liability
To the extent permitted by law, Services are provided on an as-available basis. Nothing in these Terms excludes liability that cannot lawfully be excluded. Any limitations must be interpreted under the law applicable to the customer and transaction.
10. Contact and language
Questions may be submitted through the Contact Us page. English and Chinese versions are provided for accessibility. If an inconsistency affects legal interpretation, the English version controls unless applicable law requires otherwise.
